The Privacy Policy from the Jobider Corporation (“Jobider”) informs you about the policies and procedures regard to the collection, of use and disclosure of information through www.jobider.com (the “Site”) and any other websites, features, applications, widgets and online services that are controlled by Jobider. The Service and any other information Jobider collects offline in connection with the Service. Please take note that information collected by you through any of the sites, through the Service or offline will be combined.

Please take note that Jobider is the name of the website. The word Jobider means job bidder. We use the word “Job Bidder” instead of the word freelancer to represent someone who bids on jobs online.

Whenever you access or use the service, you consent to information collection, disclosure and use practices that are described in this Privacy Policy. The Service may not offer certain features or services that are referenced in this Privacy Policy at all times. 1.Information Collection

The users of this Service may be Clients, (anyone using the Jobider platform in order to request services that are to be performed by a Job Bidder). Job Bidders may also use the Service, (companies, individual users or groups of associated individual users or companies that use the Jobider platform to offer services to Clients). Job Bidders may also operate as an Agency, which is a legally recognized entity that can hire and contract with other Job Bidders.

The information that you provide to us:

  • Personal Information

When you use the Service as a Client or Job Bidder, Jobider may require or collect information which identifies you as a specific individual and can be used in or to contact or identify you (Personal Information). Personal Information that can be collected includes your name, email, address, postal address and phone number.

  • Payment Information

If you choose to use the Services to make or receive payments, certain payment information may also be collected such as a payment card, PayPal or other financial account information as well as the billing address.

  • Identity Verification

Personal Informations such as your date of birth or taxpayer identification may also be collected in order to validate your identity or information that may be required by law such as the completion of tax filings. We may also request document that will verify the information such as the copy of your government-issued identifications or photo or a billing statement.

  • General Audience Service

The service is aimed at a general audience and intended for users that are 18 years of age or older. We do not knowingly collect Personal Informations from anyone younger than the age of 18. If we become aware that a person who is younger than 18 has provided us with Personal Information, we will uses commercially reasonable efforts to delete the information from our files.   • Non-Identifying Information/User Names

Other information like zip codes, demographic data, information regarding your use of the service and general project-related data is referred to as Non-Identifying Information and may also be collected on Jobider. Information collected from Jobider registered and non-registered users (Jobider Users), may be aggregated. User names are considered to be Non-Identifying Information. User names are made public through the Service and may be viewed by other Jobider users.

  • Combination of Personal and Non-Identifying Information

There is Non-Identifying Information that would be considered to be part of your Personal Information when it is combined with other identifiers in a way that enables you to be identified. The same pieces of information are considered Non-Identifying Information when it is taken alone or combined only with other Non-Identifying Information. Your Personal Information may be combined with Non-Identifying Information, but Jobider will then treat the combined information as Personal Information.

 

Information Received from Third Parties

Information about you may also be received by third parties. The information we collect from outside records or third parties may be supplemented and could provide information in connection with a co-marketing agreements or at your request, for instance when you decide to sign in with a third party service.

If we combine the information that is received from others with the information that we collect through the service, the combined information will be treated as it is described in this Privacy Policy.

Information collected from Users Automatically

We and third-party service providers, including analytics and third party contents providers may automatically collect certain informations from you whenever you access or interact with the Service. This information may include, among other data, the browser and operating system that you are using, the URL or advertisements that referred you to the Service, the search terms that you entered into a search engines that led you to the Service, areas in the Service that you visited as well as other information that is commonly shared when browsers communicate with web sites.

This log information is automatically collected and may be combined automatically with other information Jobider collected about you. This is done so to help improve the services we offer. This will also help us improve marketing, analytics, and site functionality.

The Internet Protocol (“IP”) addresses or other unique device identifier (“Device Identifier”), such as those found in computers, mobile phones, tablets, etc. used to access the Service, are also part of collected information.

The Device Identifier is a number that is automatically assigned or connected to the device you use to access the Service, enables servers to identify your device. There are some mobile service providers that may also provide us or our third party service providers with information regarding the physical locations of devices used to access the service.

The technology that is used to collect information automatically from Jobider Users includes:

1. Cookies:–

Cookies are used to collect information on the website. Cookies are also used by our marketing partners, affiliates, analytics and service providers in order to collect information. A cookies is a small data file that is transferred to your computer’s hard disk for the record-keeping purposes. Jobider. Uses persistent and session ID cookies Persistent cookies remain on your computer or device to save information like your registration ID and login information to the Service, which enables us to track your compliance with any Jobider applicable policies. Session ID cookies expire at the end of your browser session and are used so that you can access features of the Service, to help us better understand how Jobider Users interact with the Service and monitor aggregate usage by Jobider Users and web traffic routing on the Service.

Browser add-ons such as Adobe Flash may provides additional data storage mechanisms that are used in a method similar to cookies. 2. Web Beacons:

We and our marketing partners, affiliates, analytics and service providers may use software technology called “web beacons” or “tracking tags” which will help us keep track of what contents on our Sites is effective and to serve the relevant advertising to you.

Web beacons are small graphics that have a unique identifier that may be invisible to you, which are used to track the online activitis of Internet users. These web beacons are embedded in the web pages you review or email messages you receive.

Web beacons or similar technologies are used for various purposes including the counting of visitors to our Service, the monitoring of how Jobider users navigate the Service, counting how many emails sent were actually opened, or counting how many particular articles or links were actually viewed.

3. Embedded Scripts:

this is a programming code designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto the device you are using and is then deactivated or deleted once you disconnect from the Service.

A variety of other technologies may also be used to collect similar information for security and fraud detection purposes. Third parties may also be used to perform these services on our behalf.

How we Respond to Do Not Track Signals

Your browser settings may allow you automatically to transmit a “Do Not Track” signal to websites and online services that you visit. However, there is no general agreement among industry participants as to what a “Do Not Track” means in this context.

Work Diaries and Work view as part of the Service.

We collect information regarding a Job Bidder’s work on a project for a Client. This feature is called the Work Diary. Work Diaries include the information that is provided by the Job Bidder like a memos as well as automatically gathered information about work on a project, such as the number of mouse clicks, the number of keyboard strokes and regularly taken screenshots, which may include a webcam picture of you if this feature has not been disabled in your settings.

In order for you to use the Work Diaries, the Team App software will need to be downloaded and installed from www.jobider.com. The information that is contained within the Work Diaries will be shared with the relevant Client and any manager or administrator of the applicable Job Bidder agency. Job Bidders are informed each time information is captured from the Work Diary.

As stated in our Terms of Service, End User License Agreement and help pages that are found on the site, a Job Bidder may block or delete the screen shot and the associated data for a recorded work interval. However, this will mean that the Job Bidder may not be paid for that work interval.

Jobider may also use general information from the Work Diaries for statistical analysis, product development, marketing, and research.

User Profiles

You may create a profile that will contain information about you and include personal information, photos, and examples of your work, information on work previously done by the Service and outside the Service, skills, tests takes, test scores, feedback/ratings and other such information, including your username (“Profile”).

Jobider users and the general public can view the information in your profile depending on the privacy choices that you have enabled on your Jobider Profile.

You may edit the information in your profile through your account, and you can choose to limit who can view certain content you post to your profile.

Clients and agencies of associated individual users or companies can create an organization Profile.

Community Forums

You may participate and post content publicly in forums, blogs and through the interactive features of Jobider and other communication functionality (“Community Forums”).

You may choose through such features to submit or post questions, comments or other content.

Certain information like your name and profile may be publically displayed on the service along with your user forum content (collectively, “User Forum Content”).

Your use of community forums is subject to the Jobider Forum Rules and the Terms of Service. Anything that you post to a community forum is public and others will have access to the forum, which they can use or share with third parties.

If you choose to disclose personal information voluntarily on your User Forum Content or use Community Forums to link to your Profile, the information is considered to be public, and the Privacy Policy protections will not apply.

There are cases where we may not be able to remove your personal information. If this happens, we will inform you of this and give a reason as to why we cannot remove your personal info.

Testimonials

Personal testimonials from satisfied customers, as well as other endorsements,, are displayed on the Site. With your consent, your testimonial may be posted along worth your name.

Work Listings through the Service

If you choose to post a work listing through the Service as a Client, the contents of the listing will be viewable publicly, unless you state that the listing should only be viewable through our Service or set the work listing as private with the use of the settings that are available on the applicable website.

These work listings include information about budget, location, history of work listings by the client, the names of other Job Bidders performing work for the Client, Client feedback and rating information and the timing of project performance.

The Feedback

Feedback is collected from all Jobider Users regarding their experience with other Jobider Users of our service. Any feedback that you provide the Service or feedback that is provided for you is seen publicly on the Service.

Feedback can be removed on rare occasions in keeping with our Feedback Removal Policy.

Email to Friends and Referral Program

Jobider allows you to send emails to your friends about providing or purchasing services through the Service.

If you choose to use either feature, your friends’ email addresses will be used to send the requested posting and your email address will be used to copy you on the message to your friend or to send the message on your behalf.

Social Networking Services

You can sign up to join the Service directly through the Service or by logging into your account through the use of a third party social networking service (“SNS”) via our Service – third parties such as Facebook, LinkedIn and other such third party service that allow you to login using your existing credentials with that service.

If you choose to register though the use of a social networking service or to link your account later with the Service to your account with a social networking service, we will use the personal information that you have provided to that social networking service such as your name, contact details, gender and other such information that you make publicly available.

The information that we collect from and through a social networking service may depend on the privacy settings that you have set on the social networking service and the permissions that you grant to us regarding linking your account with the Service to your account with a social networking service.

The personal information that the social networking service has about you is obtained through the social networking service independent of our Service, and Jobider is then not responsible for it.

The Jobider service may also permit additional interactions between it and a third party site, service or another content provider such as allowing you to ‘like’ or share content to a third party social networking service.

If you choose to ‘like’, share content or share information from or through our service with a third party site or service, that information will then be publicly displayed and the third party may have access to your information and your use of our Service. We may also have access to information about you from that third party.

Your IP address may be collected, as well as the page you are visiting on our site, and we may set a cookie to enable the feature to function correctly.

The interactions that you have with third parties through social networking service or similar features are governed by the privacy policies of those third parties.

You signify that you are entitled to use your social networking service account for the purposes as described herein without any breach by you of any of the terms and conditions that govern the social networking service, and without obligating Jobider to pay any fees or making Jobider subject to any usage limitations that may be imposed by a social networking service.

You can disable the link between your Jobider account and your social networking service account at any time through the “Settings” section of our Service.

Your relationship with any social networking service is governed solely by your agreement(s) with such social networking service.

If your social networking service account terminates, then the functions that are enabled through the link between your Jobider account and your social networking service account will also be terminated.

2.Use and Retention of Information

The information that we collect is used to:

  • Provide and improve the Service, complete transactions and address your inquiries, process your registration, verify the information that you provide is valid and for compliance and internal business purposes;

  • Contact you with administrative communications and Jobider newsletters, marketing or promotional materials and other information that may be of interest to you. If you decide that you do not want to continue receiving such communications from us, please follow the instructions in the Your Choices and To Opt Out section.

  • Tailor content that we display to you and offers we may present to you both on the Service and elsewhere online.

  • Administer and develop our business relationship, and, if applicable the company you represent.

  • Assess your application to perform a freelance project for Jobider and prepare related governmental and internal statistics reports.

  • For purposes disclosed the time you provide your information with your consent and as further described in this Privacy Policy

Unless you have made a request that we delete certain information, we will retain the information we collect for at least 5 years and may retain the information for as long as needed for our business and legal purpose.

 

3.Information Sharing and Disclosure

We may share aggregated Non-Identifying information, and we may disclose Non-identifying information to third parties. Your Personal Information is not shared with third parties for third party marketing purposes unless we first provide you with the opportunity to opt in or to opt out of such sharing.

We may also share the information we have collected about you, including Personal Information as disclosed at the time you provide your information, with your consent as described in this Privacy Policy or the following circumstances:

 

  • Information about Job Bidders Shared with Clients and Agencies

Information regarding Job Bidders working on a Client project is shared including the information in Work Diaries and work history with clients. If a Job Bidder has been suspended from the Job Bidder service, we may share that information with clients that the Job Bidder has worked for or has applied to work for. We may also share information with agencies associated with Job Bidders for a particular project. If you choose to apply for work as a Job Bidder through the Service, we will share the information relevant to your application with the applicable Clients, which may include the information that is contained in your Job Bidder profile.

  • Service Providers

Jobider may employ third party companies can be employed as well as individuals to facilitate our Service, to provide the Service on our behalf to perform Service-related services like database management, maintenance services, web analytics and online advertising, payment processing, fraud detection and improvement of Jobider’s features. Third party companies and individuals may also assist in analyzing how our Service is used. These third parties may have access to your Personal Information so that they can perform these tasks on our behalf.

  • What happens if you Agree to Receive Information from Third Parties or Request that we Share your Information

You may be given the opportunity to receive information and marketing offers from one or more third parties. If you agree to have your Personal Information shared, your Personal Information will be disclosed to that third party or parties, and will then be subject to the privacy policy and practices of that third party.

Jobider is not responsible for the privacy policies and practices of the third parties, and if you do not wish to receive further communications from a third party, you will need to contact them directly.

You can also request, sometimes though your use of a social networking service or similar interactive feature or third party application that we share information about you with a third party and will do so under those circumstances.

  • Legal and Investigative Purposes

Jobider will share information with government agencies as required by law including without limitation, in connection with reporting of earnings. We cooperate with the government and law enforcement officials and private parties to enforce and to comply with the law. Information about you will be disclosed to government or law enforcement officials or private parties as we, in our sole discretions, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to the request of governmental authorities or other third parties conducting an investigation, to protect the property and rights of Jobider or a third party, to protect the safety of the public or any person or to prevent or stop activity that is considered to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity.

Device identifiers may also be used to identify Jobider Users and may do so in cooperation with third parties at our discretion.

  • Internal and Business Transfers

Jobider may share information including Personal Information with its parents, affiliates and subsidiaries mainly for business and operational purposes. We may sell, transfer or share some or all of our assets, including your Personal Information in connection with a merger, acquisition, reorganization or sale of assets or the event of bankruptcy. You will be notified via email or with a prominent notice on our site about any changes in ownership or uses of your personal information as well as any choices that you have regarding your personal information.

  • Sweepstakes, Contests, and Promotions

We may offer sweepstakes, contests, and other promotions (any, a “Promotion”) that may require registration.

When you participate in a promotion you are agreeing to the official rules of the promotion that may have set specific requirements of you and can include allowing the sponsor of the promotion to use your name, voice, likeness or another indicia of persona in advertising or marketing associated with the Promotion, except where prohibited by law. Your Personal Information may be disclosed to third parties or the public in connection with the administration of such Promotion and may include, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion’s official rules, such as on the winner’s list.

 

4.Third Party Analytics Providers, Ad Servers, and Similar Third Parties

Jobider works with and may work in the future with network advertisers, ad agencies, analytics service providers, and other vendors. They will provide us with information regarding traffic on the Service, including page views and actions taken when visiting the Service, so that we can serve our advertisements on other websites, in mobile apps and elsewhere online. This will also provide us with the information in regards to the use of the service and the effectiveness of the advertisements.

Our service providers may collect certain information about your visits to and activity on the Service as well as other websites or services. They may also set and access their own tracking technologies on your device (including cookies and web beacons). They may use the information to show you targeted advertisements.

These parties may collect Personal Information when you visit the Service or other online websites and services.

We may use a variety of service providers to perform advertising services, and some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioural Advertising. 

Opting out through these mechanisms does not mean that you opt out from being served advertising, you will continue to receive generic ads while you are online.

 

5.Your Choices and Opting Out

Jobider users can update their choices regarding the type of communications that you receive from us through your online account.

You can also opt out of receiving marketing emails from us by following the opt-out instructions that appear in those emails.

We reserve the right to send you certain communications that relate to your account or use of the Service via email and other means. These transactional account messages might be unaffected if you opt-out from receiving marketing communications.

You can opt-out of receiving text messages by replying ‘STOP’ to the text messages that you receive.

Registered Jobider Users who access the Service through the Jobider mobile application may, with permission, receive push notifications.

Notification preferences can be changed in the settings menu of the mobile application.

 

6.Changing your Information or Closing your Account

It is your responsibility to maintain the accuracy of the information that you provide us, such as your contact information. You must update any changes through your online account. If you request to access all personal information that you have submitted, and we will respond to your request to access within 30 days.

If you completely delete all information, then your account may become deactivated. If your account is deactivated or you request your account to be closed, you will no longer be able to use the Service.

If you want us to delete your account in our system, then you can do so through the Jobider Service.

We will use commercially responsible efforts to honor this request, but certain information will actively persist on the Service even if you close your account. This information includes Work Diaries and messages that you have posted on the Service.

Your personal information may remain in our archives and information that you update or delete, or information in a closed account may persist internally for our administrative purposes.

It is not always possible for information to be completely removed or deleted from our databases. We also do not remove information that you posted publicly through or on the Service. Neither you nor Jobider will be able to delete all copies of information that has been previously shared with others in the Service.

 

7.Security

Jobider takes the necessary and reasonable steps to help protect and secure the information that it collects and stores about Jobider Users.

All access to the sites is encrypted using industry standard transport layer security technology (TLS). When sensitive information (such as Social Security number), is entered, the transmission and information is encrypted using secure socket layer technology (SSL).

We also use HTTP strict transport security to add another layer of protection for our Jobider Users.

Please bear in mind, however, that no method of transmission over the Internet or method of electronic storage is 100% secure. We do strive to protect your personal data, but Jobider cannot ensure and does not warrant the security of any information you transmit to us.

 

8.International Transfer of Personal Information

Jobider is registered in Australia. If you are located outside of Australia and choose to provide information to us, Jobider will transfer Personal Information to Australia for processing. Australia may not have the same data protection laws as the country that you are in. When the data is transferred to Australia, we will protect it as described in this Privacy Policy. When you visit the service or provide Jobider with any information, it means that you fully understand and unequivocally consent to this transfer, processing and storage of your information in Australia.

Jobider is certified under the Safe Harbor Privacy Framework as set by the AU. Department of Commerce, European Commission and Switzerland regarding the collection, storage, use, transfer and other processing of Personal Information transferred from the European Economic Area or Switzerland to the AU.

The Service contains links to other websites. If you choose to click on a third party link, you will be directed to that third party website.

Even though we link to a website it is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices.

A phishing website is one that imitates a legitimate website in order to gain personal or financial information. Identity theft and the practice of phishing are of great concern to Jobider. 11.Australian Residents – Your Australian Privacy Rights

Pursuant to Australian Trade Practices Amendment (Australian Consumer Law) Amendment Regulations 2010 (No. 1) – Australian citizens that provide us with personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us, one time per calendar year, information about the customer information we shared with other businesses for their own direct marketing uses.

The law provides that a company, like Jobider, must disclose in its privacy policy that it provides the consumer the choice to opt-in or opt-out regarding sharing Personal Information with third parties for those third parties’ direct marketing purposes and information on how they will exercise that choice.

Jobider provides you this choice before sharing your personal information with third parties. If you choose to opt out at the time Jobider offers the choice, then Jobider will not share your information with a third party for direct marketing purposes.

12.Changes to this Policy

This Privacy Policy may be updated at any time by Jobider. Any changes are effective upon posting.

If there are material changes in the way that we treat your Personal Information, we will display a notice through the services prior to the change becoming effective.

At our discretion, we may also notify you by email.

We will use your Personal Information in a way that is consistent with the Privacy Policy at the time you submitted the information unless you consent to the new or revised edition.

13. Service Fee

All services offered on or through Jobider are subject to fees. The standard fee is equal to 8% of the Client’s payments plus an additional fee for disbursements. Should the disbursement be performed through a financial third party and the disbursement is done using foreign currency, we will consider the conversion rate as an addition of 1.5% by the exchange vendor?

Job bidders (freelancers) may subscribe to different levels of participation and privileges on Jobider for which they will be required to pay subscription fees.
